Enterprise Rent-A-Car® advertises itself on Its Website as a Company that Has Experienced “60 YEARS OF TRUST.” Is this Correct? Part II


Very early in the morning of November 20, 2018, I turned off my computer. Microsoft automatically downloaded a “critical update.” Two hours later when I tried to use the computer, I could not. I could not leave the startup page. I haven’t been on the computer since that morning. I am now using our local library’s computers and have not yet decided if I will try to have my computer repaired. However, it is time to start blogging again. Since I also can’t get into my old Microsoft accounts, I’m starting a new blog as of Saturday, May 4, 2019.

Background information: I purchased my first car while a sophomore in college in Illinois with cash. I don’t remember ever renting a car while living in Illinois. After we moved to Tucson, Arizona, we would occasionally rent a car, although at that time not from Enterprise Rent-A-Car®. I moved back to Illinois in June of 2004 for family reasons. I gave my car, which I had also purchased with cash (a bank check), to my daughter. It had just over 30,000 miles on it at the time. That car was the last car I have owned.

In May of 2005, one of my clients from Tucson died. As the executor of his estate, I rented a car from Enterprise in Morton and drove to Arizona to begin the process of fulfilling my duties as the executor of his estate. I rented the car for a week and return to Morton a week later. Since that time, I have only rented from Enterprise including the two plus years I lived in Abilene, Texas from June of 2013 through August of 2015. When I moved back to Morton, I routinely rented a car twice a month. After I stopped using regular credit cards because of the Experian hack, I used prepaid gift cards and rented a car using the prepaid gift card at least once a month.

My second letter to Enterprise’s CEO after I was denied a rental car on March 8, 2018:

“Debit card/Pre-paid card – Estimated cost of rental + additional $200 deposit [What is not said in the guidelines is that an additional % was sometimes taken out for using a prepaid card. A local manager warned me about this % takeout when I started using prepaid gift cards and I took that into account. In fact, on a few occasions a % was taken out above the $200 even though that was not included in the guidelines.]

My original feedback e-mail on Sat Mar 09 2019 11:20:03 GMT-0600 (Central Standard Time):

“I reserved a car under the weekend special. Friday at the office I was told I could not rent the car because my prepaid gift card, which I use exclusively, did not have my name imprinted on the card as normal credit cards do have. I have used such cards exclusively for almost two years including at least once a month at this Enterprise office. I left the office WITHOUT a car and VERY disgusted.”

The totally unacceptable response:

Dear Mr. Vance,

Thank you for contacting Enterprise Customer Service.  My name is Tania and I am happy to assist you today.

Thank you for bringing this to my attention, I apologize for the misunderstanding upon arrival at our Morton office. Our standard policies states All renters and additional drivers must be 21 or older, have a valid driver’s license and a major credit card in their name. Debit cards and pre-paid cards are accepted at time of rental with current copies of any two of the following (dated within the last 30 days and with no past due balance): telephone bill, electric bill, gas bill, sewer bill, water bill, cable bill or proof of income in the renter’s name, with his or her current address. The renter’s name and address must match their driver’s license, and their driver’s license must have been issued from the local area of the renting branch. Renters using a debit card or pre-paid card as a deposit may rent the following vehicle classes: Economy through Full Size cars, Intermediate SUVs and Minivans.

Please let me assure you that it was never our intention to disappoint you, and we appreciate you taking the time to share your expereince with us. The best ways to measure success and identify areas in need of improvement are through comments from our customers.  Therefore, I have forwarded your email directly to upper management at that location in order to review with their staff.

I had all the requirements and have rented with a prepaid card for almost the last two years. I was sitting in the car when he went to swipe my card. He then told me the nonsense that the prepaid card HAD TO BE IMPRINTED with my name, which never happens as far as I know. The standard statement of policy does NOTHING to cover my situation. Am I going to be rejected AGAIN because I use a prepaid card that does not have my name imprinted on it? He said he could be fired if he accepted the card without the imprint. 

FIX THIS. 

This was a GROSS error on YOUR company’s part. I STILL am completely dissatisfied after literally exclusively using Enterprise since 2005. Is this really the way you want to treat LONG time satisfied (Up until now.) customers? 

MY TIME HAS VALUE.

This is NOT even close to world class service.

DO NOT give me the same nonsense response which does not even address the problem. Reviewing the situation does not tell me that the same thing is NOT going to happen the next time I rent which should be this weekend since I DID NOT have a car last weekend AS NEEDED.

I was once again denied a vehicle from my local office because my prepaid gift card DID NOT have my name imprinted on it. Tell me the companies that imprint the name of the user because I know of none. This is absolutely outrageous.

Your national website is a lie. You do NOT accept prepaid cards. I also now have a copy of Group 62-Underwriting Guidelines (revised 07/2018) from my local office. The Debit Card/Pre-paid Card section of the guidelines says nothing about the prepaid card needing to be imprinted with the user’s name. This is absolutely outrageous.

If you have not convinced me otherwise by the time I get to the library on Monday, I will begin contacting State of Illinois and federal agencies about the practices of Enterprise including the seemingly fraudulent national website and/or bait and switch practices of Enterprise. This is absolutely outrageous.

Tell me every company that you know that imprints the name of the user of a prepaid gift card and the location of the company as well as contact information. Are we suppose to know by mental telepathy that our prepaid cards must have an imprinted name? Are we suppose to know where such cards are to be purchased? I do not know so how am I suppose to get such a card? This is absolutely outrageous.

You ARE NOT a consumer friendly company. You use to be. You are no longer. This is absolutely outrageous.

“I looked it up. There is at least one online. MAJOR problem: It ONLY accepts credit cards and debit cards which I do not have. If I did, I would not need to use prepaid gift cards. This is a problem that does not need to exist. There is NO reason to require my name on the card. You are removing me from the market because of your absurd rule. Of course, there is ALWAYS the Legal Tender option. 

If you find a place that will imprint my name for the cost of what I now pay for a prepaid gift card and will accept a cash payment (payment from my checking account), I will certainly do that. Otherwise, we still have a problem until you accept my prepaid card. There is also NO reason why this should be occurring. I could find nothing on Enterprise’s website OR in the guidelines posted at my local office that says I have to have an imprinted name on my gift card.

I will wait through Tuesday for your response. If I am not satisfied, I will be contacting the appropriate agencies. I also want the contact information for corporate headquarters including the e-mail address, person to contact, and his/her corporate title.

No sane person who knows how to read would conclude that a pre-paid card must have the renter’s name on it. And NONE of your managers did because I have exclusively used pre-paid gift cards since the summer of 2017 with Enterprise and everyone else. No one HAS EVER required the cards to have an imprinted name on them. Every manager knew I was using a pre-paid gift card and NONE of them EVER checked to see if my name was on the card until now. EVER.

Because you were told by someone does not make it true. Did they also tell you that they could be purchased by a cash withdrawal from a checking account because being available for purchase DOES NOT MATTER IF a credit card has to be used to purchase the gift card in the first place. I do not use credit cards AT ALL FOR ANY REASON. I DO NOT HAVE A CREDIT CARD.

I do not know the names of prepaid card companies offhand that have the customer’s name printed on them,  but will happily look that up when I am back in the office and get back to you.’  DID YOU LIE ABOUT THIS? Go onto the internet and find me ONE company that imprints the name on the card AND accepts payment through withdrawals from a checking account. If you do and the cost is the same, I will use that company. 

If I had a credit card I would use the credit card instead of a prepaid card. Your company advertises that they ACCEPT pre-paid gift cards. It says nothing about having the name on the card.

You use to be the best rental company I knew of and I have used Enterprise exclusively since 2005. Unfortunately, good companies can go bad and YOU HAVE. 

Give me the name, title, and e-mail address of the person to contact at corporate headquarters. This is utter nonsense and totally unacceptable. A consumer/customer friendly company you are not.  You have until tomorrow noon (April 21, 2019) to give me this information or I go to the appropriate State and federal agencies. I WILL ALSO BE CHECKING ON WHETHER OR NOT YOU CAN REFUSE TO ACCEPT LEGAL TENDER since refusing to do so means it is not legal tender.

I have experience in this area. Just two examples of several. In 1988, while I was living in the Tucson area and running for the Arizona House of Representatives, I rented a car at a local agency that I had never used before because my normal agency did not have a car available. At the time, the county did not have a sales tax but the city of Tucson did. The agency was located less than a quarter mile from the Tucson city line. I knew this because my district was located in this area and included both a portion of the city and a larger portion of the county. The agency incorrectly charged me the city sales tax. I discussed this with the agent and after some time she agreed to drop the tax. However, I suspected that if I was being charged so were others. I notified the State attorney for the county. The rental agency was NOT giving the sales tax collected to the State. After the State hit the agency with back taxes owed, fines, and penalties; the agency went bankrupt.

I was on President Obama’s ‘enemies list.’ When I applied for social security under my ex-wife’s account, the local agency told me appropriately how much more I would receive in social security payments. Two months later I had heard nothing from Social Security and had not received any additional payments. I went to my local office to find out why. They contacted higher up and told me that my case was a complex case and a decision had not yet been reached. Furthermore, it may take months more to reach a decision. The next day I sent a certified letter/return receipt requested to the acting social security commissioner demanding that a decision be reached so that I could immediately appeal the decision if I did not agree with the decision. I also stated that I believed I was being targeted by Social Security because I was on the President’s ‘enemies list.’ The day after my letter was received my additional money was placed into my checking account. The amount was less than ten dollars off of the preliminary amount I was told by the local agency. Later, I received a letter from Social Security stating the agency is a nonpartisan agency and its actions were not based upon any ‘enemies list.’ I had a good laugh over that declaration of innocence.

This is not close to my first rodeo dealing with private businesses and/or public agencies who abuse/misuse their power. I have far more successes than failures.

I am the Risk Manager in charge for making the rental guidelines for the Iowa, Illinois, Nebraska and South Dakota markets.  It is my understanding that you do not agree with our guidelines as to what is an acceptable form of payment in order to rent a car. 

Sean brought your concern to my attention as I was in the middle of changing the deposit guidelines all together.  Due to several concerns with prepaid cards holding more money on the customer’s side and the various different versions of them, we have decided to no longer accept prepaid cards as a form of deposit.  As of April 1st all retail rentals must either have a major credit card or a debit card linked to a bank for a deposit. Our rental offices may still take a prepaid card at the end of a rental to pay for the charges, but in order to rent the vehicle it must be on a major credit card or debit card linked to a bank. I understand that you may have used them in the past, because in the past that was acceptable.

As far as companies that issue prepaid cards to an individual, it is an impossible list to compile.  The research I’ve done on this leads to cards that are issued from an employer vs a store.  Instead of depositing a check into a bank account they issue it to a prepaid card.  Identifying the list of employers that have this option is what makes it nearly impossible to compile a list.  Since we are unable to compile an accurate list for our employees and for our customers to give guidance on what we can/cannot accept, it led us to decide not to accept prepaid cards at all as an initial deposit.  I understand not wanting to use credit for anything and I completely respect that.  You still have the option to rent with a debit card if you have one linked to a bank account.

I do not make phone calls in relation to such actions by companies. Everything MUST be in writing. ‘As far as companies that issue prepaid cards to an individual.’ This quote doesn’t even make sense. That was never an issue. The issue is companies that issued imprinted names on the card. That was the reason my reservations were denied. My card did not have my name imprinted on it. I bought it with cash (Also known as legal tender.) from my local Kroger store. Furthermore, the guidelines said nothing about my needing my name imprinted on it. I have copies of the guidelines from the Enterprise office to prove it. One copy received for each of the three times my reservation was denied. By the way, I have a 4TH reservation for later today.  

Secondly, I do not use credit cards or debit cards. The question was where I can get a card that had an imprint of my name by paying through my checking account INSTEAD of using a credit card that I do not have. 

Therefore, your asinine policy which WAS NOT included in the guidelines makes it impossible for me and many others to rent a car unless I/we use legal tender. Oh, wait. Your policy already says that legal tender is not allowed. Do you even know what legal tender is and WHY it is designated as legal tender? On every bill/currency/money that I have checked: ‘This note (Federal Reserve note) is legal tender for all debtspublic and private.’

Enterprise WAS a good, consumer friendly company. It is no more. The only option you are giving me is to see if legal tender is actually still legal tender in this country. We will find out. I did go to the local office for my reservation and was once again turned down. The policy to not accept prepaid cards because of the required $200 made your company’s behavior worse instead of better. It removed a whole group of renters. According to the guidelines, we must either use a debit card or a credit card. Nothing else is acceptable for reserving a vehicle. It also demonstrates that the previous policy had NOTHING to do with having my name imprinted on a prepaid gift card since there still is NO requirement for an imprint when used for the final payment. Quite simply, Group 62 lied to renters and to its local managers. There never was a written guideline to have a name imprinted.

I will make a reservation for Friday May 3, 2019 for the weekend special. You have three options. 1) Accept my prepaid gift card with a required $200 deposit and without my name imprinted on the card.  2) If that is rejected, accept a legal tender deposit of $200 plus the rental car fee. 3) If that is rejected, Monday I will beginning the process of contacting my local village government, my State government, and the federal government to require ALL businesses to accept legal tender or pay a stiff fine for each occurrence and to allow the injured party to sue in civil court for the same amount as damages for not accepting legal tender. [Enclosed is a copy of my last successful rental using a pre-paid gift card and an article entitled “As cashless stores expand in the U.S. so does the backlash.” Amazon had the good sense to back down from cashless stores. Will you?]

A society can not survive if a business is allowed to unilaterally reject legal tender because that means every company can and there is no longer any legal tender in the society. The article is wrong. There is a federal law in relation to cash as  legal tender.

31 U.S. Code § 5103.Legal tender

United States coins and currency (including Federal reserve notes and circulating notes of Federal reserve banks and national banks) are legal tender for all debts, public charges, taxes, and dues. Foreign gold or silver coins are not legal tender for debts.

The problem seems to be that there is no penalty for refusing to accept legal tender. I can guarantee that will change. Illinois is now controlled completely by socialists who would like nothing better than having more control over private businesses. If it comes to requiring companies to accept legal tender, the question is not will it happen. The questions are how soon will it happen and which governments will be the first? Illinois regular yearly session ends May 31st. I would expect the General Assembly to pass and the Governor to sign such a bill if pushed. And if your actions force it, I will push it and I fully expect to be successful. The choice is yours. Actions have consequences. The lack of action has consequences. Choose wisely.
