Very early in the morning of November 20, 2018, I turned off my computer. Microsoft automatically downloaded a “critical update.” Two hours later when I tried to use the computer, I could not. I could not leave the startup page. I haven’t been on the computer since that morning. I am now using our local library’s computers and have not yet decided if I will try to have my computer repaired. However, it is time to start blogging again. Since I also can’t get into my old Microsoft accounts, I’m starting a new blog as of Saturday, May 4, 2019.

The links for the first three posts in relation to my
experience with Enterprise and renting a car from the company are given at the
beginning of this post. For now, this is the concluding post in the series.
When I started my interactions with Enterprise, it was
about my prepaid gift card being unjustly rejected after being accepted for
almost two years each time I rented a car. I was caught completely off guard
and surprised. For the first time in almost four years of renting from
Enterprise in Morton, I left without a rental car for which I had a
reservation.
After Enterprise’s mid management bureaucracy doubled down
and rejected my effort to use my prepaid card as allowed by its written guidelines,
the situation changed from me to we. We as in “We the people.” When I spent the
time and money to send a Priority Mail letter to Enterprise’s CEO, it was no
longer personal. It was for all of us who, for whatever reason, prefer to use
legal tender (money/cash/Federal Reserve Notes) to transact our consumer
business rather than regular credit cards and regular debit cards. Therefore, I
intend to insure that legal tender is actually accepted as such by all
businesses and governments. We are NOT second class citizens because we have
decided to use legal tender for our transactions. We should not be treated as
second class citizens by businesses. Accepting legal tender is and should be a
part of the cost of doing business with the public.
I trust anyone, any company until I am given a reason not
to trust that person or company. When a company violates its own written guidelines,
lies about those guidelines, changes a policy for the worse instead of for the
better, violates the law with impunity, and refuses to respond to legitimate
concerns; that company has lost my trust. Enterprise is no longer trustworthy,
as far as I am concerned.
This is my proposal for solving the problem:
On the basis of a cost/benefit analysis, make it too costly
for a business to refuse to accept legal tender. For example, for each
transaction where a company refuses to accept legal tender the fine would be
$150,000. Furthermore, the individual who attempted to use legal tender and was
refuses could sue in civil court for a similar amount. Having been fined would
serve as a prima facie case in favor of the person suing the company. The
company would also be responsible for the lawyer fees for the plaintiff. The
fine would increase based upon inflation in increments of $5,000. That is, if
inflation is at 1% for the previous year, the fine would increase to $155,000.
If inflation increased by 4%, the fine would increase to $160,000 since the
inflation increase is more than $5,000 ($6,000 to be exact) the incremental
increase would be to the next highest $5,000 increment or $10,000. The company
must post in every outlet a noticeable and easily readable sign stating that
the company must accept legal tender, who to contact if the company does not,
and how to contact that government individual. The sign must also state the
fine that the company will pay and that the consumer may also sue for the same
amount with the company being responsible for the consumer’s legal fees if he
wins the lawsuit. The company can not penalize the consumer in anyway because the consumer is using legal tender.
If Enterprise may refuse to accept legal tender with
impunity, then any company may refuse to accept legal tender. If companies may
refuse to accept legal tender, then there is no legal tender in this nation and
any company may set any parameters for what they accept in payment. Such a
situation is untenable in a free society.
There are now local governments and State governments which
are requiring businesses to accept legal tender as payment. The federal
government needs to do the same if the federal government actually intends to
have an identified legal tender. At the present time, it seems that there is no
legal tender in the United States. That needs to change. Those who select to
use money are not second class citizens and they should not be treated as if
they are.
